Online Store Terms and Conditions

I. GENERAL PROVISIONS

These Terms and Conditions ("Terms") define the rules for Users, including Buyers, for using the Online Store operated by the Seller.
The Terms are made continuously available on the Store’s website, allowing Users to access, reproduce, and save their content.

II. DEFINITIONS

  • Seller – P.W MARWIS, based in Przylep, Hetmańska Street 10, tax identification number (NIP): 9730576800, registered in CEIG, conducting business activity and selling goods or providing services via the Store.

  • Store – a set of websites and IT tools managed by the Seller, enabling Users to conclude sales or service agreements, available at www.marwis24.pl.

  • Buyer – a User who concluded a sales or service agreement via the Store.

  • Sales Agreement – agreement concluded via the Store between the Seller and the Buyer for the sale of goods.

  • Service Agreement – agreement concluded via the Store between the Seller and the Buyer for provision of services.

  • Agreement – collectively means Sales and Service Agreements.

  • User – an Internet user using the Store who purchases or intends to purchase goods or services offered by the Seller via the Store.

  • PayU – PayU S.A., payment service provider cooperating with the Store.

  • Newsletter – service offered by the Seller consisting of electronic delivery of commercial information, news, promotions, and offers.

III. GENERAL CONDITIONS OF USING THE STORE

  • Users who are natural persons must have full legal capacity to use the Store.

  • Non-natural person Users may use the Store through authorized representatives.

  • Users must provide true, current, and complete data in registration and order forms and comply with the Terms.

  • Unauthorized use of the Seller’s name, Store logo, materials, and layout elements is prohibited without written consent.

IV. REGISTRATION IN THE STORE

  • Users may use the Store without registration or register using Allegro account credentials.

  • Registration requires acceptance of these Terms.

  • Only persons authorized to act on behalf of legal entities may register or use the Store on their behalf.

  • The Seller may request verification of User data.

  • Upon registration, a User Account is created, storing User data and order history.

V. PLACING ORDERS – CONCLUSION OF AGREEMENT

  • Users may browse the Store, review product/service descriptions, prices, and shipping costs.

  • Adding goods/services to the virtual cart does not obligate purchase.

  • Submitting an order form constitutes an offer to conclude a Sales or Service Agreement.

  • The Seller verifies the order and confirms acceptance by email, at which point the Agreement is concluded.

  • For Service Agreements of continuous or fixed duration, the minimum term is communicated before order placement.

VI. PAYMENT

  • The Buyer must pay for ordered goods and delivery costs within 7 days of purchase unless payment is on delivery.

  • Payments are made using payment tools available in the Store (e.g., PayU).

  • All prices include VAT unless stated otherwise.

  • Shipping costs depend on the chosen delivery method.

  • The Seller reserves the right to change prices and shipping costs, excluding already accepted orders.

VII. DELIVERY

  • Delivery is made to the address specified by the Buyer within the timeframe specified in the offer.

  • For made-to-order products, delivery time may be longer, with prior notice to the Buyer.

  • If the Seller cannot fulfill the order due to lack of availability, the Buyer is informed and any payment returned within 30 days.

  • The Seller may provide substitute performance of equivalent quality and price, informing the Buyer of the right to refuse it and withdraw from the Agreement at the Seller’s cost.

VIII. NEWSLETTER

  • Newsletter subscription requires internet access and an email account.

  • The service is free; Users pay only for internet transmission costs.

  • Users can subscribe via the form on the Store website or by agreeing during registration.

  • Unsubscription is possible via the form or the unsubscribe link in emails.

IX. PERSONAL DATA PROTECTION

  • The Seller processes User data in accordance with applicable law and the Privacy Policy attached as Appendix 2.

X. COMPLAINT PROCEDURE

  • Buyers may submit complaints electronically via the Store’s contact form or by mail.

  • Complaints must include User details, Agreement date, complaint description, and demands.

  • Complaints are processed within 14 days of receipt.

  • Warranty claims may be submitted independently based on warranty documents.

XI. WITHDRAWAL, TERMINATION, WARRANTY

  • Consumers have the right to withdraw from the Agreement within 14 days of receiving goods or 14 days from service agreement conclusion, without giving reasons.

  • Withdrawal requires a written statement sent within the deadline.

  • Goods must be returned in unchanged condition; refunds processed within 14 days.

  • Withdrawal rights do not apply to certain goods and services as per law.

  • Service agreements without fixed terms may be terminated with one month’s notice unless otherwise agreed.

XII. TECHNICAL BREAKS

  • The Seller is not liable for unavailability due to force majeure.

  • The Seller may suspend access for maintenance or improvements, aiming to minimize downtime, preferably overnight.

XIII. FINAL PROVISIONS

  • The Seller may change these Terms; changes take effect upon publication on the Store website.

  • Changes do not affect Agreements concluded before the changes.

  • Buyers will be asked to accept updated Terms when placing new orders.

  • Continuous service Agreements are subject to 45 days’ notice of Terms changes by email.

  • Disputes are subject to Polish law and courts.

  • Consumers may use out-of-court dispute resolution via the Permanent Consumer Arbitration Court.
